Privacy and personal data

  1. Controller and place of data processing

    1. GoWorkaBit Estonia OÜ and GoWorkaBit Ltd, e-mail: info@goworkabit.com, are responsible for the processing of personal data of the GWB web portal. Personal data is processed at the location of GoWorkaBit Estonia OÜ, Estonia and GoWorkaBit Ltd, London, Great Britain.
  2. Personal data and purpose of processing

    1. GWB processes personal data related to the use of the GWB service by the Service Provider. Such data include in particular: Name of the service provider, contact details, bank account details, curriculum vitae, personal image. In addition, in order to better provide the Service, GWB processes the Service Provider's device information, the Service Provider's activity log, images and location. Device information is required for troubleshooting and analysis. Images are processed by GWB only if the Service Provider adds an image to its profile. Location processing is required to display relevant Workbits.
    2. GWB may also process special types of personal data (health data) of the Service Provider if the Service Provider itself publishes the respective personal data. GWB has not imposed an obligation on the Service Provider to provide health information.
    3. When applying for a job offer, GWB has a legal need to process the Service Provider's personal identification code.
    4. GWB uses the personal data of the Service Provider for the following activities: transmission of data to the Subscriber for the provision of the Service; to exercise any rights and obligations under the law, to ensure the operation of the GWB service.
    5. Before using the data for a purpose other than the one mentioned above, GWB informs the users or asks for their explicit consent, depending on the new purpose of the processing.
  3. Location and transmission of personal data

    1. GWB does not disclose personal data to third parties without the consent of the Service Provider, except to the Subscribers of the Service, supervisory authorities, accountants, legal aid providers and in cases arising from legislation.
    2. GWB may use third parties to provide the GWB service. When using third parties, GWB ensures that the third party has an obligation of confidentiality and that the rules on the protection of personal data are complied with.
  4. Security of personal data

    1. The GWB has considered data protection issues and taken various measures to ensure data security. The processing of personal data is logged.
    2. GWB takes into account the importance of data protection when selecting its technical partners and obliges partners to comply with data protection rules.
  5. Retention period

    1. GWB retains the Service Provider's personal data only for as long as is necessary for the collected personal data and for as long as required by law. In accordance with Estonian accounting and tax laws, GWB retains data related to invoices and fees for 7 years from the date of their submission to GWB. Records of any legal transactions between GWB and the Service Provider may be retained for 10 years from the date of their submission to GWB in accordance with the general limitation period for civil claims set out in the General Civil Code Act.
  6. Rights of the data subject

    1. In accordance with applicable data protection legislation, the user has the right to:
      1. Access your personal information
      2. Improve your data
      3. Request the deletion of your personal data (right to be forgotten - GWB deletes all data for which there is no longer a legal basis for processing, but retains the fact of the deletion)
      4. Request a restriction on the processing of your personal data
      5. Request the transfer of your personal data
      6. Withdraw your consent to the processing of your personal data
      7. Oppose automated decision making (including profiling)
      8. File a complaint with the relevant authority in case of violation of the rules of personal data processing
    2. In order to exercise the respective rights, the user must contact GWB by sending an application or objection to the e-mail address info@goworkabit.com or to the postal address Nurme 37, 11616 Tallinn.
  7. Cookies

    1. Cookies are small blocks of data that are installed from the websites you visit on a user's computer
    2. GWB uses cookies in the web environment to ensure the possibility to use the web environment, better performance and analysis capabilities
    3. Cookies are used to manage the session, which monitors the user's movements and activities in the web environment, the purpose of which is to ensure the performance of the system and, if necessary, to solve problems. In addition, there are cookies that remember the user, ie the user does not have to log in again, and cookies that remember the user's language choices.
    4. GWB uses third party services that work with cookies. These include Google Analytics, Intercom and the like.
  8. Applicable law and dispute settlement

    1. The legislation of the Republic of Estonia applies to the Terms of Use and Privacy Policy.
    2. Disputes arising out of or in connection with this Agreement shall be settled by negotiation between the Parties. If the dispute cannot be resolved through negotiations, the parties have the right to apply to the Harju County Court to resolve the dispute in accordance with the legislation in force in the Republic of Estonia.
    3. In case of complaints regarding the processing of personal data, the user has the right to submit a complaint to the competent data protection authority, which in the Republic of Estonia is the Estonian Data Protection Inspectorate.
